Commission Implementing Regulation (EU) 2023/2820 (2) provides for emergency financial support for the agricultural sectors affected by natural disasters in Greece and Slovenia.

In order to ensure that the beneficiaries can rapidly benefit from the emergency financial support, Article 1(5) of Implementing Regulation (EU) 2023/2820 lays down the latest possible date for payments for measures under that Implementing Regulation, which is set on 31 May 2024.

As no payments are to be made after 31 May 2024, Article 38(1) of Regulation (EU) 2021/2116 of the European Parliament and of the Council (3) should apply so that any payment made after this latest possible date for payments is to be considered ineligible for Union financing. Consequently, Article 5(2) of Commission Delegated Regulation (EU) 2022/127 (4), providing for a proportional reduction of the monthly payments effected after the deadline, should not be applicable.

Therefore, in order to clarify the eligibility of payments, Article 1(5) of Implementing Regulation (EU) 2023/2820 should be amended accordingly.

In view of the necessity to take immediate action and clarify the eligibility of payments well in advance of the deadline of 31 May 2024, this Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

The measure provided for in this Regulation is in accordance with the opinion of the Committee for the Common Organisation of the Agricultural markets,
