EU restrictive measures in view of the situation in Burundi

SUMMARY OF:

Decision (CFSP) 2015/1763 concerning restrictive measures in view of the situation in Burundi

Regulation (EU) 2015/1755 concerning restrictive measures in view of the situation in Burundi

WHAT IS THE AIM OF THE DECISION AND THE REGULATION?

The decision and the regulation are part of the European Union’s (EU) common foreign and security policy (CFSP) toolbox, promoting the CFSP objectives by providing the legal basis for EU sanctions in view of the situation in Burundi.

KEY POINTS

Decision (CFSP) 2015/1763 and Regulation (EU) 2015/1755 have been amended numerous times. They include restrictive measures targeting those responsible for undermining democracy or obstructing the search for a political solution in Burundi, or involved in planning, directing, or committing acts that violate international humanitarian or human rights law, or that constitute serious human rights abuses, in Burundi, along with their associates. These restrictive measures include:

  • the freezing of funds and economic resources of such natural or legal persons*, companies or bodies;
  • a ban on providing funds and economic resources to such persons, entities or bodies;
  • the prevention from entry into or transit through EU territory of such persons.

A list of the persons subject to these restrictive measures is set out in annexes to the decision and regulation. The Council of the European Union decides on changes to that list.

Exemptions

The decision and regulation both allow exemptions from these measures, which include:

  • the release of certain frozen assets for legitimate purposes;
  • travel on humanitarian grounds.

FROM WHEN DO THE DECISION AND REGULATION APPLY?

  • Decision (CFSP) 2015/1763 and Regulation (EU) 2015/1755 have applied since 2 October 2015.
  • The validity of the decision has been renewed several times. It will currently expire on 31 October 2024.
